Relevant regulations on statutory holidays
●Category 1
According to Article 2 of the "Regulations on National Holidays and Memorial Days", there is a one-day holiday on New Year's Day (January 1 each year), a three-day holiday on Spring Festival (the first, second and third day of the first lunar month), and Qingming Festival. 1 day off (Qingming day of the lunar calendar), 1 day off for Labor Day, 1 day off for Dragon Boat Festival, 1 day off for Mid-Autumn Festival, 3 days off for National Day (October 1st, 2nd, 3rd)
The Mid-Autumn Festival, Spring Festival, Qingming Festival and Dragon Boat Festival are also known as the four traditional festivals in China. Since 2008, the Mid-Autumn Festival has been listed as a national statutory holiday. On December 14, 2007, the newly revised "National Festival and Anniversary Holiday Measures" officially included the three traditional festivals of Qingming, Dragon Boat Festival and Mid-Autumn Festival as national statutory holidays. Since 2008, there have been seven major national statutory public holidays, namely New Year's Day, Spring Festival, Tomb Sweeping Day, Dragon Boat Festival, Labor Day, Mid-Autumn Festival and National Day. Holidays on national public holidays are concentrated by adjusting weekends, and the holiday period is announced by the State Council every year. Local festivals, traditional festivals of ethnic minorities, and festivals of other specific groups are limited to specific groups or local areas.

In addition to holidays for all citizens, there is a second category of holidays and anniversaries for some citizens, including: Women's Day (women have a half-day holiday on March 8), Youth Day (May 4 for those aged 14 and above and below 28). ●The third category
It is a festival customary by ethnic minorities. For specific festivals, the local people's government in the areas where ethnic minorities live together shall stipulate holiday dates in accordance with the customs of each ethnic group. Employers should also arrange holidays for workers on holidays other than holidays for all citizens.
How to calculate statutory holiday pay
Article 44 of the "Labor Law" stipulates that under any of the following circumstances, the employer shall pay wages higher than the worker's normal working hours wages according to the following standards:
(1) If employees are arranged to extend their working hours, they shall be paid no less than 150% of their wages;
(2) If workers are scheduled to work on rest days and no compensatory time off can be arranged, a wage remuneration of no less than 200% of the salary shall be paid;
(3) If workers are arranged to work on statutory holidays, they shall be paid no less than 300% of their wages.
Therefore, for workers who implement the standard working hour system, if they work overtime on statutory holidays such as May Day, overtime wages should be paid at no less than three times the daily wage base, and overtime wages on May 2 and 3 should be paid Double wages will be paid based on the standard for overtime work on public holidays.
The calculation method of the daily salary base is: the monthly salary is divided by the number of days in a month. The number of days in the month after adjustments for Chinese holidays this year is 21.75 days.
Taking an employee with an agreed monthly salary of 1,500 yuan as an example, his daily overtime base is 1,500 yuan divided by 21.75 days, or 69 yuan; if the company arranges for him to work overtime on May 1, he should pay him 3 yuan of no less than 69 yuan. times the overtime wages of 207 yuan.
For overtime work on May 2, the unit should first arrange for compensatory leave, otherwise twice the daily base wage must be paid.
In addition, for "unscheduled work" positions that can be independently arranged for work and rest periods with the approval of the labor and social security department under the premise of clear workload, the employer does not need to pay overtime wages.
★Overtime pay calculation formula:
Three times daily wage = calculation base of overtime wages ÷ 21.75 × 300%
Double daily wage = calculation base of overtime wages ÷ 21.75 × 200%
Hourly overtime pay = Daily overtime pay ÷ 8
Formula description:
1. 21.75 days is the average number of payable days per month.
2. The calculation basis of overtime wages is the normal monthly wages corresponding to the employee’s position, excluding year-end bonuses, commuting subsidies, working meal subsidies, housing subsidies, mid-night shift allowances, summer high temperature allowances, overtime wages and other special circumstances wages paid.
